ARTA launches e-ARTA Complaints Management System

The anti-red tape watchdog officially launched e-ARTA Complaints Management System, the first of its kind in the Philippine government. The launch of the said online platform was the agency’s approach to digitize its services and make them more accessible and convenient to the public. It features an a) electronic ticketing system; b) paperless complaint filing; c) cloud storage for backup; and d) SMS notification for complaints. PH gears up the ATA Carnet implementation to boost economic recovery

The Philippines gears up the ATA Carnet implementation to boost economic recovery. The  Carnet System grants temporary admission of goods with relief from duties and taxes, simplifying Customs processes. It will particularly benefit the industries in the Tourism Sector, i.e., Meetings, Incentives, Conferences, and Exhibitions (MICE), in cost reduction and simplification of processes for ease of doing business. 
 
The Bureau of Customs (BOC) issued the rules and regulations implementing the system, including the National Issuing and Guaranteeing Association (NIGA) appointment and its duties through CAO 2-2022. Guidelines on the temporary admission include the, i.e., validity period, security and issuance of the Carnets, guarantee and liability of the appointed NIGA, re-exportation rules, payment of claim and refund, goods eligible, and termination of temporary admission following the mandates under the Istanbul Convention.

New regulations to be implemented on food product exports to China

China heightened food safety management measures through the issuance of the General Administration of Customs of China (GACC) Decree nos. 248 and 249. Overseas producers of food exports to China shall abide by these regulations to obtain GACC certification. This means “No GACC certificate, No import to China”. This said policy will be implemented on 01 January 2022.

Overseas manufacturers, processors, and storage facilities must register with the Chinese authorities to get the certification and have an approved registration number with 5 years validity. The registration number must be indicated on the transport and sales unit packaging of the food products for exports to China.

Senate concurs Convention on Temporary Admission ‘ATA Carnet System’

The Senate concurred the ratification of the Convention on Temporary Admission (CTA), also known as the ATA Carnet System, on 08 November 2021.  Resolution no. 128 was adopted, having 22 out of the 24 Senators voted in favorably for its concurrence.

The Department of Foreign Affairs (DFA) will deposit the Instrument of Accession to the  ATA and Istanbul Convention. This will then make the Philippines, the 88th member-state of the Carnet family.  Continue reading Senate concurs Convention on Temporary Admission ‘ATA Carnet System’

BOC clarified errors not fined under CAO 1-2020

The Bureau of Customs (BOC) allowed adjustments on minor errors, misdeclaration, or misclassification in the Export Declaration (ED) form without having to pay the fines.  A fee amounting to Php 5,000 per clerical error and 250% surcharge per misdeclaration or misclassification is still imposed if discrepancies in the ED are fraudulent.
BOC identified certain conditions that may not equate to an error provided that documentary evidence is present. Also, considering that the incorrect input of data in the ED is beyond the exporter’s control, as follows:

DOF-BOC-ARTA headways onboarding activities of the 18 priority agencies in TradeNet

The Department of Finance (DOF), Bureau of Customs (BOC), together with the Anti-red Tape Authority (ARTA) headways the onboarding activities of the eighteen (18) trade regulatory priority agencies in TradeNet; Six (6) of which were recently onboarded which include BAFS, SRA, FPA, EMB, NMIS and OMB. These agencies are still finalizing their module manuals, operational guidelines, and helpdesk in preparation for their live implementation. The TradeNet Steering Committee also pledged to include another twelve (12) agencies to onboard by September 2021.

EDC lauds DOF and BIR deferment of 12% VAT on indirect exports

EDC lauds the Department of Finance (DOF) and Bureau of Internal Revenue (BIR) on deferring the implementation of Revenue Regulation (RR) no. 9-2021, which levies 12% VAT on indirect exports pending issuance of an amendatory regulation. BIR will provide the transition process for those who already paid the 12% VAT while the RR was in effect from June 27 to July 21, 2021.

DOF and BIR granted the petition of the grappling MSMEs passionately echoed by Albay Rep. Joey Salceda during the Committee Briefing on Ways and Means on July 21, 2021. The solon added that we are not yet over the pandemic hence suggested it is best deferred as a way of support to the sector.

ARTA launches the Philippine Good Regulatory Principles Manual

The Anti-Red Tape Authority (ARTA) set another milestone as it virtually launches via zoom the Philippine Good Regulatory Principles (PGRP) Manual on 01 July 2021 as a commitment to implement regulations based on the right principles of regulatory management.

Accordingly, these principles are composed of ten guidelines that support the conduct of a Regulatory Impact Assessment (RIA) and strengthen the country’s ease of doing business. BOC implements alternative Prepayment System in addition to PASS5

The Bureau of Customs (BOC) implements an alternative Prepayment System (BPS) to pay duties, taxes and other charges for all goods declaration lodged through the Electronic to Mobile (E2M) system. The BPS in compliance with the Customs Modernization and Tariff Act (CMTA), will only allow Exporters and importers to register an account for transaction payment purposes.  Funds in the said account cannot be withdrawn but can be transferred to other prepayment accounts of the same holder’s name. Duterte empowers streamlining initiatives by creating a Cabinet-Level Office to cut red tape

President Rodrigo Duterte created the Office of the Presidential Adviser on Streamlining of Government Process (OPASGP) through  Executive Order (EO) no. 129 signed 13 April 2021. Secretary Leoncio “Jun” Evasco Jr., as the newly appointed Presidential Adviser to streamline government processes will work closely with the Anti-Red Tape Authority (ARTA).

EO no. 129 aims to ensure harmonization, integration, and non-duplication of all government initiatives on ease of doing business which heighten the mandates stipulated under the Republic Act (RA) no. 11032 or the Ease of Doing Business and Efficient Government Service Delivery Act.

Moreover, the EO shall “advise and recommend to the President or the ARTA, evidence-based policies, programs, measures and strategies that will further simplify processes and cut red-tape in the Executive branch as well as Local Government Units (LGUs) and expedite the delivery of public goods and services to the Filipino people.”  

With this, exporters may look forward to better governance and ease in doing business in the country.-MRJ
